1. Who these terms apply to
These terms govern the clearing and forwarding services provided by [Company Legal Name], a licensed customs clearing and forwarding agent, to any client who submits a quote request, accepts a quotation, or engages us to handle a consignment.
2. Quotations are indicative until confirmed
The Request a Quote wizard on this site produces an indicative estimate: our own service charges are calculated from our published fee schedule and are firm at the volumes stated, but the duty and tax figure shown is an estimate based on an average total tax incidence applied to your declared invoice value. The actual duty payable is set by the assessing customs officer on the day the Bill of Entry or Bill of Export is filed, based on the HS classification and the assessed value, and may differ from the indicative figure. No quotation is binding on either party until we have confirmed it in writing against your actual shipping documents.
3. Your responsibilities
You are responsible for the accuracy of the commodity description, HS code (where supplied), invoice value and quantities you give us. We rely on these to classify your goods and prepare your declaration; incomplete or inaccurate information can result in a delayed clearance, a rejected declaration, or a customs penalty, for which we are not liable if the information supplied to us was incorrect.
4. The duty-advance facility
Where agreed in advance, we may advance customs duty, VAT, AIT and regulatory duty on your behalf from our own funds, and recover the amount advanced together with a facility charge — the current rate is shown on the quote wizard as a percentage of the amount advanced — on your final invoice. This facility is offered at our discretion and is not automatic for every consignment.
5. Demurrage, detention and free time
Port demurrage and shipping-line detention are charged by the port authority and the carrier respectively, on their own tariffs, once a consignment’s free time has expired. We track free time on every consignment we handle and will notify you as it runs low, but we are not liable for demurrage or detention charges that accrue because of a delay outside our control — including a late document handover, a customs query, a physical examination, or a port or carrier operational disruption.
6. Consignment tracking
Each consignment we open is given a reference number, which you can use on our Track Consignment page to see its clearance status without needing an account. You are responsible for keeping that reference confidential where its disclosure could reveal commercially sensitive shipment activity to a third party.
7. Payment
Our service fees, any amount advanced under the duty-advance facility, and any third-party costs we have arranged on your behalf (transport, warehousing, port handling) are payable as set out in our invoice. [State your payment terms — e.g. due on presentation, or within a stated number of days.]
